Biden Mistreatment of Military Is ‘Gut-Wrenching,’ Liberty Counsel’s Mat Staver Says

What Joe Biden is now doing to soldiers who refuse to follow his unlawful orders is nothing short of appalling. The so-called “commander in chief” who left Americans to die in Afghanistan is now abandoning and abusing religious military members and their families overseas unless they agree to take his unlawful jab.

Yesterday, we returned to court in our class action lawsuit, Navy SEAL 1 v. Biden. Biden’s Department of Defense operates as if it is above the law. But the court ordered the DOD to stand down.

It is gut-wrenching to hear the stories of these brave heroes and how they are being mistreated. This must stop.

Very little the Biden administration does surprises me anymore. Just one year into office, and Biden’s rank disdain for the Constitution and individual liberty has been painfully obvious for all to see. But what Joe Biden is doing now to soldiers who refuse to follow his unlawful orders is nothing short of appalling.

First, he tried to dishonorably discharge and jail any armed forces members who refused his unlawful shot orders. Our staff worked with Congress to pass a law forbidding him from dishonorably discharging these military heroes for refusing the shots. Now Biden is discharging these religious faithful “without honor,” which is an insult to these men and women who have served honorably.

Next, Biden threatened other discharge punishments, such as repayment of education, training, loss insurance and benefits. But the unvaccinated men and women of the U.S. military still refused to deny their deeply held religious convictions to comply with Biden’s unlawful orders.

In our class action lawsuit, Navy SEAL 1 v. Biden, the DOD is arrogant. This “we are above the law” attitude did not sit well with Judge Steven Merryday. The judge wrote in an order granting emergency relief that the military is well aware of the “frailty” of its legal arguments.

Now Joe Biden is simply abandoning our troops—again.

Defend our Defenders

Military members from around the world, including South Korea, Italy and Germany were on our most recent legal help conference call. The callers were advanced military members with numerous years of highly technical training and expertise, including pilots, radar technicians and medical staff like doctors and nurses.

Each told a similar story—Joe Biden is leaving military members stuck far from home and even in foreign lands—unless they take the COVID jab.

Commander Duncan and his family received orders to move last year. In June 2021, the military packed up the Duncan family’s house and belongings to ship them overseas. But then Biden delivered his shot mandate, and everything changed.

Commander Duncan and his family are now living out of suitcases in temporary quarters, wondering if they will ever see their belongings again or be allowed to return home.

Mitchell writes, “My family and I are stuck in limbo with no household goods because they have been shipped to the east coast from Hawaii.” But because he has a religious objection to the COVID jab, Joe Biden’s DOD stopped processing Mitchell’s transfer and is leaving Mitchell and his family more than 5,000 miles from everything they own.

Army SFC Young is stationed in Korea. She was supposed to return to the U.S. on May 9, but because she refuses to take Biden’s jab, she has been informed she will not be allowed to leave Korea.

“Please help me get out of Korea,” SFC Young wrote. “I was only supposed to be here for one year.”

Leaving armed forces members and their families stranded is nothing short of revolting, especially when the military’s own actions prove the unvaccinated are not a threat to the force.

You see, Biden’s military has granted thousands of medical exemptions to the COVID jabs. By allowing those unvaccinated individuals to continue serving while categorically denying religious exemption seekers is outright discrimination and bigotry. Religious exemption seekers pose no more threat to the military or general public than medical exemption seekers. Yet the Biden administration continues to deny service members their constitutional right to religious liberty.

Liberty Counsel has been fighting for the rights of every member of the armed forces, federal employees and civilian contractors as part of our class action lawsuit, Navy SEAL 1 v. Biden.

Yesterday, Merryday extended the temporary restraining order protecting our plaintiffs until Feb. 18 in order to give him time to write his opinion. This is a good sign, and I ask you to please keep this judge and our plaintiffs in prayer.
