Victory: Supreme Court Rules on Unconstitutional Vaccine Mandate

The American Family Association, afa.net, praises the decision of the United States Supreme Court on Jan. 13 when it concluded that the Biden administration’s vaccine mandate on companies with 100 or more employees was unconstitutional. The administration has tried to enforce the mandate through the use of the Occupational Health and Safety Administration.

“The Supreme Court issued a ruling against President Biden’s unconstitutional mandate that businesses with at least 100 employees must require workers to get a COVID vaccination or get tested weekly and wear a mask,” said Tim Wildmon, president of the American Family Association. “The mandate for businesses took effect last Monday, but is now unenforceable.

“We thank God for this victory that allows Americans to continue to enjoy freedom to make their own health choices.”

AFA said from the announcement of the Biden/OSHA mandate last year that the executive branch was violating the constitutional limitations on its authority. AFA produced a video on the Supreme Court ruling.

“Every ounce of this proposed executive action is illegal and unconstitutional,” said AFA General Counsel Abraham Hamilton III. “The United States of America is a constitutional republic with representative democratic features. Our Constitution separates power within the federal government. In our federal executive branch, we have a president. Not a king! Nowhere in the Constitution will you find any authority whatsoever for the [Biden] administration to compel private companies to force their staffs to inject their bodies with anything or test them. Period.”

AFA, along with other organizations and businesses, argued that OSHA’s emergency regulation enforcing the mandate had vastly exceeded the limited authority of the executive branch agency and that the expense would cripple many private businesses. There was also widespread fear—and this cloud may still hang over the economy—that if hundreds of thousands of workers quit their jobs instead of accepting vaccination, the economy would go into reverse.

AFA Executive Vice President Ed Vitagliano stated, “AFA will continue following this issue and continue voicing a Christian perspective. The court answered our concern about Biden’s overreach, but it left open the question of what private employers might do. Thursday’s holding does not affect whether businesses mandate vaccines for their own employees. We will continue supporting our members any way we can.” {eoa}
