Vaccine Mandate Crumbles as Liberty Counsel Intensifies the Battle

On September 11, 2001, James* was sitting in his high school biology class when the news came—America was under attack. While James had always felt a strong urge to serve his country, news footage of flames and destruction in New York City, Washington, D.C. and a fallen plane in a Pennsylvania field cemented his desire to serve.

Later, James enlisted in the U.S. Air Force, where he has faithfully served ever since. From boot camp to the present, James’ service has been exemplary, earning the highest ratings and commendations in everything from fitness and academics to service in a theater of war.

Despite suffering a tremendous physical injury in Iraq, James now leads over 2,000 airmen attached to special forces. In fact, James’ skills are so refined that he is one of less than 600 U.S. armed forces members worldwide qualified to provide the services his job requires of him.

At the beginning of the pandemic, the Air Force determined James was “mission essential.” Despite his lack of a COVID vaccination, James was required to continue providing in-person services for the Air Force. His services were in such demand that throughout the entire year of 2020, James only received a single personal day off from his job, which is so important to the military. During that time, James fell ill with COVID but recovered completely.

Despite James’ spotless service record and the very limited number of other armed forces members who can fill his role, Joe Biden is about to kick James out of the military because James refused to forfeit the religious freedom he has vigorously defended.

James is a devout Christian, and as such, he dutifully filed a religious exemption request from the COVID jabs shortly after the mandates were announced. Further, his recovery from COVID gave him natural immunity—immunity that would be compromised if he took the experimental jabs.

Nonetheless, James’ exemption request was denied. When James filed an appeal, the military refused to allow him to review any of the reasons his exemption had been denied. On December 27, 2021, James was informed that he must take the jab within five days or be kicked out of the Air Force he has so faithfully served for his entire adult life.

To add insult to injury, James was informed that the Air Force would “make an example” of him, and that he would face demotion, court-martial with a possible felony conviction and involuntary separation.

When Liberty Counsel appeared in court on behalf of James and others just over a month ago, Joe Biden’s DOD told the judge that no retaliatory actions would be taken against armed forces members seeking religious exemption from the jabs.

The judge ordered the DOD to report on the status of every religious exemption request service-wide beginning this Friday and continuing every two weeks thereafter. James’ experience, and the experience of our other clients, shows that servicemen and women are having a very different experience than what the judge intended.

Liberty Counsel will once again request the court issue an injunction preventing Joe Biden from further violating these service members’ right to physical autonomy and religious freedom.

Further, a Texas judge recently issued an injunction preventing the Navy from enforcing Biden’s unlawful shot mandates. While this injunction only applies to the 35 Navy plaintiffs, it bodes well for the injunction request on our case, in which we represent members of all armed services as well as federal employees and civilian contractors.

Please be in prayer for a positive result—that religious freedom will prevail—even in Joe Biden’s military.

The past two years of fighting religious tyranny have taxed our resources. Tyrants criminally charged and arrested pastors for daring to open their churches for their flocks. An entire congregation was put on the equivalent of house arrest for daring to attend a stay-in-your-car church parking lot Easter Sunday service.

Churches were slapped with steep fines and even threats to seize and destroy buildings. And this year, Joe Biden continues his mad quest to violate the physical autonomy and religious freedom of every American who refuses COVID shots—even though the jabs are harming and killing many nationwide.

Religious freedom has never been under such massive attack in my lifetime. But Liberty Counsel will not stop until every American’s religious freedom is fully restored—including the right to say No to Joe Biden’s jabs. {eoa}
